Trey Gowdy grills Napolitano on prosecutorial discretion

Trey Gowdy wants to know from Napolitano if prosecutorial discretion has any limits whatsoever, making the point that it’s the legislature’s job to pass laws and the job of the executive branch to carry them out:

    I said it before and will say it again: Trey Gowdy is a rockstar. Don’t let these lawless liars and reprobates get away with ANYTHING. I’m thrilled that he’s on them… same with Darrell Issa. Too many people have let this corrupt cronyism go by unchecked… and criminals like Janet are setting precendence and trying to side-step our laws in doing what they want.

    Gowdy, Issa, Chaffetz, etc. are finally doing their job and calling BS what it is: BS.

    Congressman,it is true prosecutors do have some degree of discretion as to which cases to prioritize.Unfortunately you are dealing with a merry band of lickspittles who take their orders from an AG who is as crooked as a dog’s hind leg.His only priority is protecting a hopelessly corrupt regime who ignores laws that are not to their advantage and only prosecutes cases that would impede this administration in furtherance of a governmental power grab.Like immigration laws,the marijuana laws you referred to and voter ID laws which would obstruct the voter fraud thay find necessary to gain unfair advantage in furtherance of the communist/socialist cause.I don’t understand a word of this and I just wrote it.

  • Trey Gowdy is one of the sharpest members of Congress, in either party. He makes a fantastic point when he questions where is Congress’ recourse if the Executive branch decides to ignore laws? He mentions de-funding or stopping funding of a department, but Congress can’t do that every time the Obama administration decides to break the law. Where I disagree with the Republican leadership is that it IS about time Congress start withholding funds for SOMETHING. They are not even trying. Cut off funding for all of these unconstitutional “czars,” cut off funding to Health and Human Services for gutting the 1996 welfare law, cut off funding for illegal wars like the one in Libya that was not sanctioned by Congress, or cut off funding to the UN for trying to have international law trump American common law (espcially when it comes to international laws against private gun ownership). So far, Congress has not done a thing to stop the president’s grab for more power. It’s about time it starts, or else in a few years it will just be irrelevant.

    Talk about a slippery slope! The libs need to think long and hard about how they would feel if a conservative decided to pick and choose which laws they wanted to enforce. Did I just say that the libs need to THINK? That’s just not going to happen, is it?

    So, basically, she’s saying that the administrator has discretion on what law they will enforce, based on their mood and the color of the Tye they are wearing to work the day they put out a personal priority memo. The Constitution is used for political convenience, not as a document to preserve the rights of citizens and restrain the burdensome overreach of the fed.

  • Rep. Gowdy has a great hold on the matter, I wish he had had a few minutes more to completely strip search her authority to nullify the law past by the legistrative branch, and and then asked Mrs Napalitano what was the legistrative branch remedy.
    The remedy would be, remove from office, she and Holder.
    At one point Rep. Gowdy said to her, becareful it may come back to bit you.
    Maybe, just maybe, a clue?

      I wish he had stated that Congress has repeated said no to the DREAM act, legalizing this batch of illegals. And then she and the pResident in our White House overrode them because they disagreed with Congress. Separation of Powers violation! Start the impeachment today and add Nap to the list.

    I still can’t understand how South Carolina can elect two republican senators, Jim DeMint and Lindsey Grahamnesty, that are so different in their political positions. DeMint fights for his people and Grahamnesty is a Rino lapdog for McCain. Replace Grahamnesty with Gowdy and get back to sanity. Take back America, one RINO at a time.

      I don’t get it either. Back in 2008 we tried to get Miss Lindsey out. Sadly, only 20% of registered Republicans bothered to vote in the primary.

      • Must have something to do with his military service or something to do with his help to successfully Impeached B.Clinton or maybe South Carolinians aren’t going to give up their elected very easily without a strong reason.
        I’m not sure 20% is correct, I think the number is much higher, but even so, S.C. voting turnout for the 2012 election will be much different, the turnout will be record breaking.
        No challenger means we vote rino-Mr Lindsey. Any Democrat is no option.

    The Obama administration officials are absolutely shameless in their stonewalling. Gowdy gets 5 (count them FIVE) minutes to make his point and “force” the official to answer. All the official has to do is hang on for 5 mins and act dumb.

    Congress has the ability to hold these folks to account, but they won’t do it. It’s taken them almost 2 years to hold Eric Holder in contempt of Congress! Not enough time left in this session of Congress to follow through. There is no way Congress can oversee the behemoth bureaucracy. Which is why they need to cut the Federal gov’t in a BIG way.

    350,000 cases in the backlog. If they knew these were young people brought her illegally out of their own volition, they have already built the cases for prosecution. 350,000 x 3 = 1,050,000 illegals that they know about. That is on the light side, likely 350,000 x 8 or even 10. Romney needs to issue warrants for the arrest of 100% of them and deport them.
