WATCH: Constitutional lawyer schools MSNBC host on Trump and ‘obstruction of justice’

Much to the chagrin of this MSNBC host, constitutional law professor Elizabeth Foley totally shoots down the idea the FBI is independent or that Trump obstructed justice in any way, shape or form.

In this first clip she addressed why the FBI is not independent and begins to get into the obstruction of justice claim:

Foley argues that as a matter of statute or the Constitution, there is no legal firewall between the FBI and the executive and it bothered her to hear Comey suggest in his hearing that the FBI was independent. She said that’s categorically false.

Also neat little history lesson on Hoover and why the FBI director has a 10 year term.

The second clip is where she hits back at the MSNBC host Yasmin Vossoughian, explaining exactly why there simply can’t be obstruction of justice.

She basically argues that even ‘corrupt intent’ as a matter of law is irrelevant, that the power given to the president is plenary, meaning it’s unqualified and absolute. The only case in which ‘corrupt intent’ is meaningful is in the political arena, where there can be political consequences to remedy such a thing.

The entire interview is very good and worth watching.
