Andrew McCarthy: Obama’s plan to pardon possibly thousands of drug offenders a MASSIVE ABUSE of power

According to Andrew McCarthy, our lawless president plans to go around Congress and rewrite the drug laws by using his pardon power to grant clemency to a whole category of drug offenders, all because he disagrees with the law:

It’a a massive abuse of [the pardon power]. Look, he’s got a lot of raw power. The president has enormous power and the pardon power is there for good reason. If, in individual cases, injustice has been done; if there are mitigating circumstances in a case that warrant correction, that’s why the president has the power.

But he’s not talking about individual cases here. He’s talking about a category of federal law that he philosophically disagrees with. So he’s essentially going to rewrite Congress’ laws by springing everyone. This is not about individual justice in cases and mitigating mistakes or hardships, this is about rewriting federal law.



While McCarthy doesn’t agree that there is a racial aspect in our laws that create this disparity where blacks and punished more than whites, he does believe that one can make a good argument why our drug laws need more work by Congress to lessen this disparity. But despite this, he says the president doesn’t have the power to effectively change laws by decree.

I can’t believe I have to defend anything this administration is doing, but I actually think this is a good thing. Prisons are overcrowded and there are too many people in prison that are not dangerous. The President actually has the power to pardon. He is not, in this instance excising power he doesn’t have.

In response to Meagan Kelly and this prosecutor on the rule of law B.S.: there are no fair trials in Federal Court. Discovery rules are much more favorable to the prosecution in Federal Court, and Federal prosecutors have over a 95% conviction rate. That is obscene. So if the President want’s to pardon some crackheads I say go ahead. It will be the only thing he has done right.

Individuals yes, but he doesn’t have the Constitutional authority to overturn criminal statutes. As a matter of fact, as chief law enforcement officer, he is duty bound to enforce the law equally. To do otherwise, to quote Andrew McCarthy, is a MASSIVE abuse of power.

He is not overturning statutes, he is commuting sentences. The statutes are still on the books, and people can still be prosecuted under them and sent to prison. The Constitution does not stipulate what his motives have to be. If a President thinks a person or a group of persons are imprisoned unjustly, there is nothing in the Constitution which limits his power pardon.

The real power abuser in this situation is Congress when it decided to exercise a police power it does not have under the Constitution by creating Federal Crimes that can be handled under state law.

Article Two section 8 gives the President the power to grant “reprieves and pardons for offences against the United States, except in cases of impeachment.” He can pardon a single individual, a class of individuals, or the whole damn prison system if he so desires. I understand the word “individually” I am just unsure as to why you and so many people think it applies.

I am by no means a supporter of this administration, but I value consistency and intellectual honesty. I am not going to criticize Obama for abusing power when he is actually, for once, acting within the powers granted to him by the Constitution. The President gives us ample opportunities to criticize him.

He has the power to pardon someone who has been wrongfully convicted or sentenced unfairly for the crime committed. A review of the evidence and the judicial proceeding would be required and of course the determination of a “fair trial” would be on an individual basis.

The president is not a king. He does not have “enormous power”. He does not have the powers he has been USURPING from We the People unless Congress – the supposed representation of We the People, fails – or refuses – to stop him. He cannot exceed his power unless he is allowed to do so. If Congress does not grow a spine and stop him, they are complicit in making a king and destroying this free country.
