Ninth Circuit says Trump ‘discriminating’, rules against travel ban

As Michelle Malkin put it, this is the non-shockiest non-shocker of the day:

ASSOCIATED PRESS – Another federal appeals court has upheld a decision blocking President Donald Trump’s revised travel ban.

The ruling Monday from a unanimous three-judge panel of the 9th U.S. Circuit Court of Appeals deals the administration another legal defeat as the Supreme Court considers a separate case on the issue.

The judges say the president violated U.S. immigration law by discriminating against people based on their nationality and that Trump failed to show their entry into the country would hurt American interests.

They didn’t rule on whether the travel ban violated the Constitution’s ban on the government officially favoring or disfavoring any religion.

As you already know, Trump appealed the 4th Circuit decision to the Supreme Court so this 9th circuit decision doesn’t really change anything.

I know some have argued that enough time has already passed with respect to what the travel ban called for, so that it is no longer necessary. But this fight is not just about the travel ban any longer, it’s about proving that the ban is constitutional and that the president has the absolute authority to implement it.
