WATCH: Rudy Giuliani explains why FBI Director is WRONG about Hillary intent

Former prosecutor and NYC Mayor Rudy Giuliani was on CNBC today expressing his dismay at the FBI Director’s conclusion that no reasonable prosecutor would press charges against Hillary Clinton:

Giuliani first points out that gross negligence, which Comey seemed to ignore, was absolutely met based on the evidence that Comey himself presented.

But more than that, Giuliani says that Comey knows that intent is normally proven using circumstantial evidence, and the best circumstantial evidence you can have is gross negligence.

Furthermore, he adds that her destruction of 34,000 emails also proves intent.

Giuliani says this is an extremely hard decision for Comey to justify, suggesting that because of this it will be almost impossible in the future for the FBI to get a prosecution under these statutes.
