    I just refreshed my memory about Tax Penalty:

    A Tax Penalty is an involuntary payment or enforced contribution imposed by the government as a punishment for a crime or offense tied to an action (or more precisely inaction) or infraction of a rule. The punishment can be exacted pursuant to legislative authority in monetary or prison terms.

    Sure, you pay or you go to jail!! And we’re supposed to be ecstatic? That’s not fun!

    Except for the rubes who will believe anything, this isn’t going to fly with Americans. It can’t be one or the other. The Supreme Court has stated it is a tax. Not a tax penalty, a penalty, a fee, or anything else. It is a tax. First it wasn’t, then it was, now it’s whatever Nancy and Obama say it is? I don’t think so. Give it a week or so, and see how flipping angry Americans get over this. It’s coming. All those people in the middle who haven’t paid a lot of attention, but who are not stupid, are going to get angry over this.

      And the Governors who resist expanding Medicaid will be bombarded with anecdotal stories of weeping mothers claiming their children were saved only because Obama stood against the evil, murdering, greedy Republicans.

        However, the “godfather” of this monstrosity isn’t really to be slammed too much. States have the right to create whatever they want, in their State, hence the reason all States should be considered sovereign. This was actually a right the State of Mass. has the right to do. The one thing so far is, Romney hasn’t been hit with a sound bite that places him with wanting this nationwide………..yet.

        I am far from defending this man, as he is far from what I would want at the “helm”, but it is what I get to look forward to.

            Hey Freempg, I agree with ya, trust me, been bashed for being a Ron Paul supporter. I am not defending the man, just his policy was Constitutional for the State of Massachusetts. As for the subsidies, I knew this, just defending his right as a Governor to do for his State as he sees fit, nationally, not Constitutional. I also will add this, I don’t see him repealing the law fully, he keeps saying the worst part, replace, and I ask “with what?” So as a typical RINO, he likes part of the bill, just not how it is written(aka written by Dems, not Repubs).

    If it’s not a tax then the law is unconstitutional. The only reason the court upheld it is because it’s a tax if democrats deny it’s a tax than the law does not stand. it’s that simple. Every time a democrat claims it’s not a tax the GOP response needs to be “in which case the law is unconstitutional”

    What the GOP needs to do now, is go back to the court with a new case. Arguing that the law was passed under false premise and should therefore be unconstitutional for that reason alone.

      There is no false pretenses clause in the Constitution. Although, Scalia did comment at oral argument that the statute might violate the Constitutional prohibition on Venality (laughing; there is no such prohibition).

        However, there is an Origination clause and taxes are supposed to originate from the House, which the penalty (declared a tax) did not. That is the basis for getting rid of Obamacare. They can’t have it both ways, unconstitutional under the Commerce clause and illegitimate under the Origination clause.

          There has been much discussion of this. Actually, technically, it did originate in the House. The Senate took a House bill that had come to them on some other subject, amended it to add Romneycare and strip out the other stuff, and sent it on its way. Sleazy right? But evidently this maneuver has a long history.

            It’s all about technicality. They not only amended it, they gutted it and changed it completely. The long history doesn’t include Supreme Court declared Taxes. It will be interesting what the Republicans do with that.

            Edit: When you say it originated in the house, you’re not talking about the tax. That’s key.

            Sorry I don’t buy into the theory that Roberts’ decision was wrapped in some genius rational. No it wasn’t. If he didn’t run scared of what the left would think of him, the law would have been thrown out and we still would have a great chance of throwing out Obama in November.

            The left know how to win and I’m ready to get in the gutter and fight these bastards. Not think of ways of making me feel better about losing. We lost another one when it should have been won. A long time before November.

              It was legal theater, to whip the liberals asses for the next 100 years. Roberts wants to leave not only his relatively young kids a stable America, like the one he enjoyed, but he wants to leave us one as well.

              He’ll gladly take torment to achieve that end.

                  I can’t get past the lie that this is a constitutional tax. You either have integrity, or you do not. If not, then you are no good to any just cause. A legal tax has to be equal and fair constitutionally. I don’t really care what ploy he may have in mind. He is a Justice for life, what does he have to be afraid of? The only sacrifice he made was the trust of the people.

                  I do not take this personally, though it is extremely disheartening. I fully expect our government to succeed in shutting down our republic, and have no such hopes of any electoral change taking place. In fact, I have to thank Justice Roberts for removing any false hope that I have had in the courts.

                  Where does it say that? Is a cigarette tax fair? Is a gas tax equal? There are many taxes that I would deem unfair and many unequal.

                  The taxing and spending clause includes it by using the word “uniform”. This interpretation is supported by the concept of equal justice under the law. I have heard the arguments, but could not offer you a complete explanation while giving the exact constitutional text.

                  It is unlawful to favor one individual or group in these laws. I certainly wouldn’t argue that we have been even “mostly” constitutional. We have not. Most of what government does is extra-constitutional, or flat out illegal.

                  This is an extension of my last post.

                  For instance:

                  They never repealed Posse Comitatus, they just passed the Patriot Act and the NDAA.

                  They never repealed having Gold and Silver behind our currency, they just created the Fed and went off of it all together.

                  They never repealed Glass-Stegal, they just passed a new law opening up mortgages to derivative trading.

                  The never repealed the requirement that congress declare war, they just created some other way of authorizing the use of force to take down other sovereign nations.

                  Article one section eight requires that all taxes be apportioned according to population. The sixteenth amendment does not override the original constitutional declaration on taxation, therefor our tax code is illegal, and so are any laws passed that go against this article.

                  You really need to bone up on your Constitution, particularly the 16th Amendment, it modified Art 1 Sec 9 and did away with apportionment.

                  As to the worn out “declaration” of war meme, that has been so thoroughly thrashed here, over and over it does not even bear rehashing the argument.

      Roberts has changed the the entire healthcare debate to taxes. The Left is in hyper-defense of raising taxes now, as evidence of Piglosi double talking about how the largest tax in world history isn’t really a tax at all. With the obamascare win, the obama surrogates can only lie to us now about how the tax isn’t really a tax. How far do you think they are going to float that boat?

      They will also try to tell us how wonderful his healthcare will be but will they be able to sell mediocre coverage at such a high tax confiscation?

      As stupid as many of our fellow Americans have been protesting Wall Street and praising obama without any acknowledgement of any of his lies, this will be a time that might stop and listen. They have nothing to protest, they won the obamatax debate.

      Roberts was going to be the fall guy either way, it is better that the left believe they have a win and let their guard down and the right mobilize to get obama out and fill the halls of Congress with Conservatives. Also, the left has been singing Roberts praises, and with their simple minds, not reading the tea leaves, it’ll be difficult to attack him when they catch on.

      Obama has attacked Roberts and the SC many times, as President, you don’t do that, as a dipstick President, you really shouldn’t do that.

      Time will tell, but I’m with Rshill7 on this one, try to keep an open mind, there isn’t a whole lot more to look forward but ABO and hope he will repeal. There is also no reason to hate Roberts, that will not make your life easier nohow.

        Just did. I’m trying to sort out everyone’s opinions amongst all the insults and ad hominems. Are you in favor or against Roberts’ decision? I’ll admit, he may have handed the Republicans ammo for the election but at what cost? What a dangerous game to play violating the Founder’s definitions and limitations on the power to tax. Not to mention the outright activism of re-writing the law when it didn’t mention the mandate as a tax.

        I’m so sick and tired of Republicans waving flags and quoting the Constitution at rallies and at Tea Parties and then abandoning it the first chance they get. Sick of it. I’m convinced we lost the Cold War and Stalin is laughing in his grave.

          BSScoop, I totally understand your frustrations at the GOP- they frankly suck. Ever since I’ve lived here, I’ve been a staunch conservative (actually, I was one in Canada too- hard thing to do when everyone around you is stuck on socialism). But the more I look at it, and like you, wade through all the back and forth, I have to say I am coming to see Roberts as doing something genius here. Will it cost? We won’t really know for now, but I think… no, I have to believe that it could be a good thing. Toongoon said it superbly above. I think time will tell, but for now, just to see the demtwits running around trying to paint over the “tax” word- and having it heaped in dear leader’s lap in the biggest of election years is a bit of relief.
          I can’t stand mittens, and I have made myself clear on the fact that the GOP shoved another lame candidate down the voter’s throats… Seeing that mittens is the one who started this whole socialized crap, perhaps Roberts saw this as one of the very few ways he could get around it… Make the demwits scramble, and make the people so angry that if mittens wins, he will have no choice but repeal it.

The problems that our elected leaders have created might, at this point, be too overwhelming for any man or group of men/women to solve. The hits keep coming from the left and the right doesn’t seem to have the fighting spirit.

              It is all in the hands of the people now. Through preparation, unity, and most importantly, prayer we can turn this ship around and get it off of the rocks. The light is exposing so many evils at this point and we must continue to shine the light and keep those committing the evils on the run until there is no place left for them to hide. Trying to build a young family? By 2016 expect to be paying more than 2K a year in HI premiums. Hell, why should the Insurance companies cap the cost of their premiums? Everyone has to buy one. The problem for the HI companies is that the Government is going to artificially make themselves the only viable Insurance Company on the market long term by force.

    Obama, Pelosi, and the rest of the rats lied to you. I wouldn’t be surprised if they knew it would come to this, which is why they had their lawyer argue it was a tax in front of the Supreme Court. Their strategy is to rely on MSM propaganda, lies, and deception to buy themselves enough time to institutionalize this legislative terrorism into the fabric of the country. If the vast majority of the MSM wasn’t far left kooksville liberal, the rat infested Democrat Party would never get another vote unless that person was deceased or named Mickey Mouse.

    A majority of Americans opposed this bill the day it was passed. The Democrats deceptively passed it right down ideological party lines, with full cooperation and protection from the MSM.

    All of your support for Obama, Pelosi, and the Democrats won’t stop the IRS from coming after you. People are going to feel what it’s like to support irresponsible meddling liberals where it matters, their wallet.

    Watching this video, two thoughts came to mind. One, thank you Scoop, for giving us only 31 seconds of Pelosi. And two, she is and always will be a dingbat. Of that, I’m sure everyone on this thread will agree.

    After reading all 89 comments (so far) on this thread, I see very few, if any, liberals commenting. So, it makes me sad that both sides of this argument are coming from conservatives who all want Obama repealed in November. We are eating our own, folks.

    Roberts, whether you like his decision or not, has given us an opportunity. I, for one, dislike his ruling. But there is no appeals process to the Supreme Court. We use what is given to us and make lemonade out of lemons. This November is going to be interesting for several reasons.

    Roberts called the penalty a tax (I disagree. I think it is not a tax. But he ruled it was). We can use this in the campaign against both Obamacare and Obama. Democrats, like Pelosi, are adamant in declaring it is not a tax. Why? Because it will hurt them in November if they admit it is a tax. Use this.

    Roberts basically sent Obamacare back to the Congress. The Origination clause states that taxes originate in the House. Not bills that weren’t taxes and then were changed to taxes, without ever going back to the House for redress. Congress should vote on this to get the Democrats to either vote against it or run on tax increases in November. Either way, they lose.

    Roberts not only ruled in our favor on the Commerce clause and the States right to opt out. He also stated a very important point, without ever saying it. We cannot depend on the Supreme Court (nine people, of which at any given time there are 4 on one side and 4 on the other with a possible swing vote) to save us from ourselves. We are the ones that elect our officials and we are the ones responsible for either keeping them or getting rid of them. We can’t cry when it goes all the way to the Supremes and then one man decides the fate of a nation. This happens way too often in the ninth circuit, but at least there it gets appealled.

    What I’m trying to say in 1000 words that I should have been able to say in 50 is that what is done is done. God gives us the ability to choose (free will). Let’s see if we can use that ability for a good cause and get Obamacare fixed the way it should have been, as well as kicking Obama to the curb in the process.

    The Democrats are amazing how quickly they assemble their talking points. Lew, the WH Chief of Staff, was saying the same thing on Fox News Sunday – that only 1% of the people would choose not to buy insurance and would be affected by this new “tax.” However, the way it has worked in Massachusetts, far more than 1% have decided to pay the tax or penalty instead of buy insurance, since it is cheaper. Then, if they ever need insurance, they get it since they can’t be denied for pre-existing conditions. The result significantly drives up the cost of health care.

    The Roberts decision vastly increases the taxing power of Congress by essentially creating a new tax – a tax on inactivity. In other words, you either do (a)_______, or pay a tax. There’s no limit as to what can be plugged into (a). That’s the problem. We are witnessing the destruction of our Constitution and the limits it places on government power over the individual.

With Harry Reid, her counterpart in the Senate, it is easily understood why we are on the verge economic disaster with the Federal deficit.     We know millions will be dropped from their employer based health insurance. We aren’t all going to be able to afford the entire cost of an insurance policy, and most of us won’t qualify for medicaid (and I don’t want to).

    The new group of uninsured is going to be a lot freaking larger than it was before Obamacare.
