    The great thing about the Article V convention is the DC media/lobbyists/ruling class are ill equipped to stop it. They have little influence over local legislators, there is no political machinery in place to go after them. There are too many state legislators and they are too spread out. Unlike DC where power is concentrated in relatively fewer people all in the same place.

    If GOP leaders in state houses would just engage in a little coordination, this could happen very quickly.

    And these state politicians should want to do this for selfish reasons, since the Liberty Amendments transfer power to the states.

    The time to strike may be after the 2014 elections if there is another red wave.

      DC has full control over local legislators. Where do you think a large chunk of funding comes from to run states? That’s right, Barack Obama. He will use the Chicago thug machine to launch their own convention with one rule, support the destruction of the Constitution or lose all of your federal funding. If you think shutting down the memorials was bad, wait until the interstates, state highways, telecommunications and other services paid for, in full or partially with federal dollars are shut down.
      Obama is wise beyond what we give him credit for as is Holder. They are way ahead of conservatives in this area.

          You don’t fight back by opening the Constitution to destruction. You do what many have posted, you get on school boards, you get elected to city council, county commissioner, state legislators.
          As important, you get the liberal judges OFF of your courts and replace them with Constitutional conservatives. Judges rarely have opponents so now is the time to go through their decisions and take to social media, find an opponent and campaign like your life depends on it, because it does. With control of the courts we have a MUCH better chance.

            This is EXACTLY the proper path: it’s legal, it’s Constitutional, it cannot be interfered with by any federal entity or state governor. It’s the one peaceful path left open to us.

              The Constitution is NOT destroyed. Saying it is is like yelling FIRE in a crowded theatre. The Progressives can absolutely have their own path running and the federal $$$ will cause the “conservative” states to cave in a heartbeat.
              Ask yourself this, do you trust Jan Brewer? Chris Christie? Scott Walker? Bobby Jindahl? John Kasich? Tim Scott? Bill Haslam? I’m sure there are many others. I certainly don’t.

                The list of unconstitutional things going on in DC is massive, and growing exponentially every single day. We are clearly in a post-Constitutional period, and things are accelerating—accelerating—away from the Constitution. Soon it will be a mere memory, honored only in terms of dates of elections, lengths of terms, and age requirements. EVERYTHING ELSE is up for grabs.

                  I am not being absurd. Exaggerating gives the progressives and trolls ammunition to attack Conservatives. Do you still have your Constitutional right to post at this site? Yes. Do you still have your Constitution right to bear arms? Yes. Is it being challenged? .
                  Has there been a lot of unconstitutional behavior in DC? Are our rights being challenged? Yes. Are we winning important court cases and retaining our rights? Yes.
                  Was the ObamaCare decision a re-writing of the law? Yes. I don’t disagree we are being challenged. But handing the Progressives the manual on how to quickly and permanently destroy the Constitution is not the answer. Levin himself a week or two back said it could take 20 YEARS to fix this. It’s won’t take Obama long to run his parallel and get to the finish line LONG before we could. Look at how quickly he changed up the SCOTUS, flipped the takers to be the majority, and destroyed our health care system. Plus he has unlimited financial resources and more attorneys than Delaware has citizens.
                  This is what I learned from ObamaCare – DO NOT trust the states.
                  This is what I learned from Ronald Reagan. Amnesty for illegal aliens is the fastest way to destroy the sovereignty and financial health of the United States. He was the first president to EVER grant amnesty and now we have 10 times the number of illegal aliens here because of it and Reagan Amnesty #2 is right around the corner being pushed by the GOP!
                  If one were to follow your post, the ObamaCare lawsuits should all be dropped, no new ones should be filed, don’t bother to run for office in 2014 and don’t support conservative candidates either. In fact, just give up and hope the Levin method works. Trusting our Constitution to 50 states with ELECTED officials and the majority of their funding determined and awarded by the OBAMA ADMINISTRATION (how true were those elections) is dangerous. State elected belong to the same GOP that has worked to destroy this country at the federal level and that is a FACT. The GOP wants the control as much as the Progressives, look at the gun control votes and the votes to fund ObamaCare. They will also work against the effort.

      What happened in Philadelphia? The people thought they were only ‘amending’ the Articles of Confederation not creating a centralized government under a new Constitution. It can happen again but it will destroy the Constitutional Republic that Franklin and the rest gave us back then.

      • The convention for proposing amendments will be nothing like a political party nominating convention. No group gets to show up all ready to take over the process (like the RNC and a few dolts always do at the Republican National Convention). There is no organization that gets to “run” the Convention for proposing amendments.

        The delegates show up and decide how it will be run, and who will serve in what capacity during the convention.

        Each state gets one vote, so no particular state can take over the convention by sending a massive delegation.

That’s the clear meaning of “shall call for a Convention”.” Think about the logic of that for just a minute. The RNC (and DNC) “call” for their conventions, too. Aren’t those conventions supposed to be about the delegates doing the deliberating? Aren’t those conventions designed to be so “the delegates show up and decide how it will be run and who will serve in what capacity during the convention?” But…in reality, is that what occurs? HELL no!

    Alleluia!! State rights, 10th amendment go go baby! Bill O’Reilly answered one of his veiwer letters tonight by saying, the Constitution is unclear and up for interpretation…and that is why we have the Supreme Court to help us interpret it! OMH….the Supreme Court is there to uphold the Constitutional laws….we the people have allowed the Constitution to be so distorted, by the Supreme Court, POTUSes and Representatives…that is why we are not living by it! Am I making sense?

        I think there needs to be accountability…this is not the first time O’Reilly has said this. He believes it..and no one can correct him.

        He did something rare last night…he was in the wrong and belligerent, to a Conservative woman (?) and after the commercial break he apologized…there are a good many that need to edit their mouths!! Understand your frustration!

      You are right on target. There is a book called “1913” where Oliver DeMille gives all of the details about how the 16th & 17th amendments, the FED, and the US vs Butler in 1936 threw all of the restraints off of the House and Senate and what they were allowed to spend money on. Way too much to go into here. Prior to 1936 they could only spend money on the 20 powers enumerated in Article 1, Section 8. He also discusses what Mark wrote about in “Men In Black” about how the Supreme court assumed the power to be the only and final arbiters of what the constitution means, what’s constitutional and what isn’t starting with Marbury vs Madison. For instance they have authority under the original constitution to say that segregation in schooling is unconstitutional, but ordering the remedy, busing, is not their discretion.

      If we could just fix those 4 things, we’d be back on track. AND IMO put the Supreme Court back in it’s place. I think the whole idea of 9 people un-elected and unaccountable to the sovereigns, us, flies in the face of everything that I am aware of, of how this outfit is supposed to work.

      News to me, too. Thanks for a good comment. I’m also hopeful, but concerned. One of the hotheads in your camp says you have control or partial control of thirty-four or thirty-five state legislatures. If so, you need sufficient control of three or four more. Counting New England states and west coast states, you may have quite a hill to climb and get three fourths of fifty. I’m too old for crusades, but I will keep listening, counting, and reporting anything that might have value.

      Hotheads aren’t worth much. They’re inclined to take the point, play Superman, and stop a speeding bullet. Once, as a popular ventriloquist says.

          I might have suggested that two should think three or four times before trying to tell others what they, the others, are thinking and where they stand. Coming back from a meeting, I’ve not found the seemingly youngest of the two. Aboutdat would have been the second, but he gave me opportunity (intentionally or not) to tell him that I’d like the Article V effort to succeed despite the more than a dozen blue states, some with deep pocket supporters. They may fight hard and dirty. I’m sure you’re ready for that, and neither fearful nor overly confident. U S Grant gave us, “No enemy is half so dangerous as an unreliable ally.” Treason is terrible, fear problematic, and overconfidence is worse than even severe fear.

      I was glad to hear that as well. After Levin announced his book I started looking around, and found that there were people who were already looking into this issue. Levin just gave it national attention.
      BTW, I’m the “hothead” that Grumpy’s complaining about.
      He sniped the idea, and it’s supporters, in another thread, and when I said something he took offense.
      Basically, he’s too busy counting the states he’ll never get and throwing his hands up, rather than trying to help us be successful in getting as many states as we can. And since he’s convinced himself of defeat, or at least not winning, he made every attempt to keep “Levin and Co” (us) at arms length.
      It’s like telling your team to forfeit the game because your opponent only needs one more point than us to win.
      I can see that he seems a little more supportive in this thread, and I’m glad. I’d just prefer to hear more “we” and “us” when discussing this movement, rather than “Gee I don’t think it’s going to work, so you guys have fun”. I’m not saying you have to be on the front lines, but at least offer to stand up with us and hold our coats while we fight.
      I guess the thing that bugs me the most is that you never see the left do this themselves. I’ve never heard a Dem say “You know this universal health care idea is never going to pass and be popular. Let’s just table that idea for now.” We have to be unified, and resolute.
      I got a 5 month old at home, and I’m concerned about what we are leaving him, so try and forgive me if I my patience gets a little short with those who don’t seem to have the stomach to do what is necessary.

        This is patently false. The federal government has exactly one part to play, and they cannot do anything but issue a call, once they are in receipt of the requisite number of applications. None of the federal system has any say in what happens next. Neither do states’ Governors. The only ones involved are the legislatures of the states, and they will send delegates to do exactly what they are mandated to do. No more, no less.

          That’s not a good argument against the Article V process; even if we got a ‘Reagan’ into office with all-Rep congress, history has proven it will not last. Steps must be taken now to permanently cut back the power of future Congresses.
          Remember, our founding fathers were the MINORITY…they just persevered.

This “convention of the states” will not have representation by the people, it will only be state legislators and they are full of socialists and RINOS and that’s exactly what they want. It is unconstitional and a bad idea. Let’s stick to the Constitution we have and hold our representatives to it…that is what the Founders expected of us and we suck at it! Look in the mirror.

                  The specific requrement in Article Five is that Congress has no ability to “decide” anything. That’s the clear meaning of “shall call for a Convention.”

                  Schlafly has been thoroughly rebutted by several Constitutional scholars. Her entire case is based on a misconception over the notion of a “Constitutional Convention.” This is not going to be, and cannot legally be, a “Constitutional Convention.”

                  Get up to speed or be left behind.

          The libs, and establishment RINOs, have been changing the Constitution for decades now without a convention process. This portion of the Constitution has always been there, if they had cared to use it to alter the structure of the nation they would have done it already. We’re not coming up with anything new, just something that’s never really been tried.
          Listen tot he Senator in the clip. They are passing laws with felony penalties to make sure their delegates follow specific protocols. Plus the agenda is preset, and the Amendments that are proposed have to fit inside that criteria.
          Even Lev in was skeptical of this process, but after some research, has determined it’s a good avenue to take for us.

    There are many rights put into words which make up the Constituton, the ultimate right is borne of the Declarartion of the Independence, the right of alter/abolish, embodied in the legal right to a convention. The other side of the convetion process is the consensus of the People, the final word is that of the People, therefore there is no reason to limit a convention.

    • The process will be conducted within the legal framework of the Constitution itself. It will be limited by several factors. The process itself is fully Constitutional and therefore will survive all legal challenge.

      Rewriting the Constitution is not going to happen. The applications must be for the same reasons, they must specify the intent of the convention, and no state will pass a resolution for an open-ended process.

      You’ll see the US Congress vote for term limits on itself before a state will give up even more power to the federal leviathan.

        Nothing in Article V requires applications “be for the same reasons,” nor that they “must specify the intent of the convention” with the exception that the convention be “for proposing Amendments.” THAT is the legal framework. The States are not obligated to tell Congress anything in their application other than that they want a “Convention for proposing Amendments.”

        Suggesting otherwise requires reading things into Article V that simply aren’t there.

          Take for instance the talk of a “balanced budget amendment” sounds good right? BUT if you drill down into the language that I have seen for this so-called amendment all it does is puts into the Constitution a base line budget which is why we have most of our financial troubles today. So what you’ll end up with is MORE RUN AWAY SPENDING MANDATED BY A CONSTITUTIONAL: AMENDMENT. Because if they bump up against their limit on spending what do you think congress will do??? They will RAISE TAXES BECAUSE THEY HAVE TO BALANCE THE BUDGET ACCORDING TO AMENDMENT XXVIII OR WHATEVER NUMBER IT IS GIVEN!!!

        • The logic is obvious: if you apply for a convention for amending the Constitution to let Arnold Shwarzenegger be President, and I apply for a Convention for making Oprah a permanent ambassador to Antarctica, then those are not counted as the same thing.

          This is exactly why so many thousands of prior state “applications” have never met the “two-thirds” requirement.

          This is history, and legal precedent, by the way. These conventions have happened before, and will happen again. We know from the legal precedent that each state gets one vote, for example.

          That is also obvious, even though it’s not written in Article Five or any other article.

            You folks keep claiming “these conventions have happened before,” when in fact you know there has never been an Article V Convention called, let alone conducted, concluded, and its work-product referred to the states for ratification.

            Any assertions you make regarding how an Article V Convention would unfold are mostly conjecture. And it is still an exercise in futility if public servants are not made to follow the Constitution.

            The blind arrogance I see from the proponents is amazing. You expect Americans to get excited about and to support a solution that doesn’t solve that fundamental problem.

            We already have an amendment prohibiting the infringement on the “right of the people to keep and bear Arms” yet the feds (and most states) do it all the time. How would you fix that via amendment, by adding “and we really mean it this time!” to the end?

            Until the American people demand the “supreme Law of the Land” is upheld, it is foolish and ill-advised to amend it by either process authorized in Article V.

        • No it was not. It was called specifically to address the “Constitution of the government,” which was not working well at the time. It was initiated by the states separately asking the Articles Congress to call for it. The Articles Congress did not do so “upon application”. They mulled it over and decided it would be a good idea, so the Articles Congress specifically called for that convention.

          The current Article Five process gives Congress no such opportunity to decide anything.             If the specifics of “applications” and the “call” matter, then history shows either Congress didn’t “call” a convention with the latitude the states wanted, or the states didn’t limit themselves to the “sole and express purpose of revising the Articles of Confederation” for which the convention was called.

            You can’t have this lie both ways. The facts suggest some states wanted to do more than simply “revise” the AOC, but the call language agreed to by the representatives of the several states in Congress assembled, didn’t authorize it.

            If anything, this is evidence that We the People couldn’t trust the states to constrain themselves at such a convention, once convened, and those men were by far more trustworthy than the likes of delegates attending an Article V Convention today.

            You try to suggest I don’t know what I’m talking about, but I’m not the one making stuff up to validate my arguments. You can’t say out of one side of your mouth that Congress doesn’t have “authority to decide anything,” and then claim they have the authority to limit Article V Conventions based on the content of the applications. That’s mosaic thinking at best. Congress’ refusal to call a convention is indicative of their resistance to any effort to limit their power, not that Article V authorizes such behavior. There’s no reason to trust Congress, or the state legislatures, or you. Amending the Constitution won’t make public servants uphold it. Every dime spent on this fantasy con-con con is a dime that could and should be spent on vetting and electing honorable men and women who will actually keep their oath.

            We should focus on upholding the Constitution as written, not pretending that amending it will make the people in government defend our God-given Rights.

    Snake oil salesmen are everywhere, preying on the misery index of the people, while lining their pockets with your money. Use some common sense and ask yourselves this one question:

    If, as clearly as the language is now, the people we elect won’t uphold the Constitution as written, how will amending it make them follow the newly-amended Constitution?

    Ask yourself one more question: If state legislatures won’t uphold the Constitution now to protect our God-given Rights, what makes you think they will do so after its been amended?

    The only honest answer is they won’t. The “solution” being proposed by Levin, Natelson, Meckler, Martin (Tea Party Patriots), and others doesn’t even address the problem they identify, let alone the root problem. They each are enriching and empowering themselves at Joe and Jane Citizens’ expense with empty promises and professionally-crafted delusions. Please don’t be a sucker.

              What you and the other proponents of an Article V Convention avoid like the plague is how amending the Constitution will NOT make politicians (at all levels of government) actually follow the Constitution.

              The pro Article V Convention crowd claim the need for it is a “runaway, out-of-control federal government.” Even the anti-Article V crowd doesn’t disagree that the federal government is out of control. What they primarily disagree with is your proposed solution being a solution at all.

              The problem isn’t the Constitution, so why are you so hell-bent on amending it? The problem is spineless state and local government officials who refuse to protect the rights of the people against government intrusions.               Congress disagrees with you on how “the process” would unfold, and how much authority Congress (or the states) have over that process.               The Supreme Court put it on the docket, but delayed ruling until the second deadline had passed, thus rendering the challenges moot.

              The state legislators like Senator Long, who is blocking anti-Obamacare legislation in Indiana from even having hearings, are tyrants in their own right.

              You suggest there is no comparison to be made between political party conventions and an Article V Convention. I disagree. You cannot remove the human element from the process. Corrupt, power-hungry political operatives elected to positions of power within the leadership at an Article V Convention will manipulate the rules, and strangle the process, silencing debate, silencing parliamentary inquiries, and railroading the delegates to simply be rubber-stamp participants, ensuring those in control of the convention get what they want. It won’t be a deliberative body, but a political theater.

      Defunding could absolutely work – if we actually had anyone in th House who understands the Constitution and Bill of Rights, and had any courage of conviction.

      In fact it is the responsibility of the people’s representatives in the House to take any and all actions to defend the nation against an Executive Branch illegally exceeding its authority, a Senate that operates outside the law, and a Court that believes it can legislate.

      State nullification of Obamacare combined with absolute defunding by the House would kill Obamacare – illegal legislation.

If shutdown happened and no DEMS decided to join (happened) at least we would know who was on our side and who was against us.
      If re-pubes backed up Cruz and Lee, during shutdown (Ocare stopped on hold) we could have got the people to demand a delay, BUT I THINK WHAT HAS HAPPENED IS JUST FINE WITH ME THANK YOU GOD!
