The 11th Circuit Appeals Court judges put a stop to Georgia prosecutors who subpoenaed Sen. Lindsey Graham and were compelling his testimony on Tuesday in another Democrat-led effort to exact revenge on Donald Trump.
The whole thing is so scammy it’s hard to believe they’ve gotten away with this case this far.
Constitution much?
The temporary hold on the subpoena gives consideration to the argument Graham has made repeatedly that he should be exempt from this type of testimony because of a little old thing that we like to call the Constitution. So no big whoop.
Surprise surprise.
U.S. District Judge Leigh Martin May, an Obama nominee, initially denied the request from Graham and his attorneys to quash the subpoena. May is a former Democrat party activist and worked with both the Georgia State Democratic Committee and the Civil Justice PAC as a board member.
Guess what?
The appeals court has ruled that the district court actually has to take the Constitution into consideration and determine what kinds of questions a lawmaker is exempt from having to answer because of the chilling effect it would have on debate and legislative functions.
Before he can be compelled to testify, the district court has to determine as a matter of law whether he’s “entitled to a partial quashal or modification of the subpoena to appear before the special purpose grand jury,” based on the speech and debate clause in the Constitution. That decision is a successful appeal of Friday’s decision by May that she would not issue a temporary stay pending his original appeal to not have to testify. See she wasn’t even going to let his appeal go through before he was compelled to testify. So Graham appealed THAT and won, and now the District Court has to weigh the law and THEN the Appeals Court panel will review the initial appeal.

The case, you may or may not recall, is an “election probe” launched by activist Democrat district attorney Fani Willis. Last month she was barred from expanding her witch hunt investigation to include current Georgia Republican Lt Gov nominee Burt Jones because she was FUNDRAISING FOR HIS OPPONENT.
Activist Democrat Judge, activist Democrat District Attorney, ignoring the Constitution and using their offices to go after political opponents — and then they are flabbergasted we see all this as partisan corruption. The media has the audacity to treat it like WE are being unreasonable.

Btw, CNN was just clinking their champagne glasses on air Friday saying that Graham lost his “bid to avoid facing” the grand jury after District Judge Democrat Activist May turned down his request for a temporary stay. Beside themselves happy. The heartbreak you know is rocking CNN’s offices right now is a great aspect to this story.
