Joe Biden was slammed today for trying to simply declare an amendment as port of the US Constitution.
Biden wrote on X today that “the 28th Amendment is the law of the land” because some states have ratified it:
Today I'm affirming what I have long believed and what three-fourths of the states have ratified:
The 28th Amendment is the law of the land, guaranteeing all Americans equal rights and protections under the law regardless of their sex. pic.twitter.com/oZtS6Q89zG

He was quickly hit by a Context note on his post saying “The National Archivist who is responsible for enrolling new amendments has stated that that the ERA has not been lawfully ratified, citing a legal opinion drafted by the Biden Justice Department’s Office of Legal Counsel in 2022 confirming this position.”
Others like Governor DeSantis also chimed in, pointing out how ridiculous this ‘declaration’ was:
Pretty sure an executive amending the Constitution by merely deeming it amended wouldn’t have passed muster with the founding fathers.
But if we are casting James Madison aside and are just deeming amendments enacted, can we please get term limits for members of Congress? https://t.co/gD6xfKDAuh

No he didn't. He says he did, but because he can't, he didn't. https://t.co/hu3zAnN0Qa

Apparently the dementia riddled president's online meme team thinks a Twitter post is how Constitutional Amendments are made. https://t.co/Va0CG7N2vk

Looking forward to President Trump citing “the Biden rule” when he begins unilaterally changing the Constitution via social media posts. Biden truly is the gift that keeps on giving. https://t.co/pDY8SEphfv
