California really loves to sue Trump and they’re already concocting another lawsuit to file, this time over the border migrants.
Specifically, they want to sue over the tear gassing of migrants who tried to storm the border on Sunday:
FOX NEWS – California’s top law enforcement official on Wednesday said he is evaluating whether the state can take legal action over the Trump administration’s use of force against a migrant caravan and threats to close the U.S.-Mexico border.
Attorney General Xavier Becerra told Reuters in an interview that the state could have cause to step in if a state resident was being affected.
“We have been approached by folks who have expressed complaints,” Becerra said. “We are monitoring what’s occurring.”
However, Becerra told the outlet that he “can’t act unless the rules are on our side.”
The federal government has sweeping control of the border and immigration administration, which limits California’s ability to take action against the use of tear gas or border closures.
This is ridiculous. Obama used tear gas many times against migrants and we never heard once that California was working on a lawsuit against his administration for it.
Of course they can only file the lawsuit if they have standing, and for that to happen they need a California resident to have been affected by it. But even if they find a resident, who for whatever reason, was in the mix of migrants that were tear gassed, a lawsuit on this is still absurd. Border officers had rocks being thrown against them. They had to disperse the migrants and they chose to do it with non-lethal force.
Any reasonable judge would throw a lawsuit like this out on its merits.
