BREAKING: Judge lifts 50-year injunction on 150+ year old abortion ban in Arizona

Pima County Superior Court Judge Kellie Johnson has ruled for Arizona attorney general Brnovich and against Planned Parenthood, lifting an injunction and allowing enforcement of a near-total ban on abortion.

That territorial-era law has existed since before Arizona was a state, but has been affirmed more than once since statehood. The injunction has been in place since Roe v Wade, almost 50 years ago.

“The court finds that because the legal basis for the judgment entered in 1973 has now been overruled, it must vacate the judgment in its entirety,” said Judge Johnson in her ruling.

The law is commonly referenced as having been enacted in 1901, however a version was put in place first back in 1864. It was in 1901, 11 years before statehood, that the language was more specifically codified while Arizona was still a territory. It was affirmed once again in the 1970s.

The decision in Planned Parenthood v Brnovich means that the will of the people of Arizona will be carried out on the question of abortion, as the Attorney General remarked in a tweet soon after the ruling was handed down.

Planned Parenthood of Tucson is heartbroken that their massacre has been interrupted. “Today’s ruling by the Pima county superior court has the practical and deplorable result of sending Arizonans back nearly 150 years. No archaic law should dictate our reproductive freedom and how we live our lives today,” they said in a statement.

The left will treat the law as archaic because it is old. So is the Constitution and its Amendments. And so is morality. And newsflash, civilization and humanity have always opposed murder.
