Democrats introduce bill to BLOCK Trump from using national disaster to build the wall!

Democrats are trying to block Trump from using disaster powers to build his wall at the border.

A group of Senate Democrats, including several 2020 contenders, have introduced legislation that would prevent President Trump from using disaster relief funds to finance a wall along the southern border.

The “Protecting Disaster Relief Funds Act” would block Trump from taking funds allocated to the Department of Homeland Security, the Department of Housing and Urban Development or the Army Corps of Engineers for disaster relief and using that money to construct physical barriers along the U.S.-Mexico border.

he Democrats backing the bill include several senators who have already entered the presidential race — Elizabeth Warren (D-Mass.), Kamala Harris (D-Calif.) and Kirsten Gillibrand (D-N.Y.) — as well as Bernie Sanders (I-Vt.), who is reportedly on the verge of making his announcement.

Harris said in a statement announcing the legislation that Trump “cannot go around Congress to fund his ridiculous vanity project.”

“I’m proud to introduce this bill today to ensure that funds intended for victims of natural disasters do not go towards a wall that Congress won’t fund and people on the border don’t even want,” she added. “This bill will stand up for Congress’ power of the purse and help California families affected by recent natural disasters begin the process of recovery.”

There’s a few Republicans who have voiced opposition to Trump’s action, but that doesn’t necessarily mean they’ll vote against it. Even if they do, and it passes Congress, Trump can easily veto the bill. THEN, in order to overturn his veto, Democrats will need way more Republican votes than they probably have. And that means that Trump will probably prevail, at least from legislative challenge. Next up, the judicial challenge….

Next, re-reading Daniel Horowitz, I’m not sure he’s right about his interpretation of section 224(a) (what he’s claiming is some exemption from deportation of human traffickers) because…

1) section 224(a) only applies to unaccompanied minors

2) section 224(b) puts in exceptions for human trafficking. The critical word in there is “pending.” If you read it as including *suspected* traffickers, then it includes them all.

Now, to followup my comment regarding “permanence,” we can look at some of these probably-not-permanent policy riders of which Daniel Horowitz wrote. First, the “55 miles” of barrier everyone is talking about… the number does not appear in the bill. It was arrived at by a back o’ the napkin calculation of border barrier costs vs. the allocated amount, and was babbled out into social media. It factors nothing else into it (like cost savings). Second, the Rio Grande Valley Sector is huge… Rio Grande Valley Sector agents patrol over 320 river miles, 250 coastal miles and 19 counties equating to over 17,000 square miles. . So freaking out over section 232 as preventing *any* barrier construction is a bit extreme. After all, the limitation only applies to section 230 funds. I have read the draft text of the bill. I unequivocally support the bill.

It is both sad and tragic that Congress has to put forth language to prevent the President from raiding previously appropriated funds for purposes that Congress did not authorize and would not authorize. That Defense funds, which should properly be used for national security, are poised to be extracted from the Pentagon is repugnant. This intended diversion of funds demonstrates that the Trump Administration’s language supporting the nation’s troops is hollow. For the Administration, the nation’s troops are a lesser priority despite the vast sacrifices they make on behalf of the nation’s security and its people. Then again, it should not be surprising that national security is de-emphasized by an Administration that is currently engaged in the biggest retreat from world affairs of any during the post-World War II era.

How does anyone gain standing to challenge any of this? It can’t just be shoved into the docket for judicial review. I’ve seen some of los lealistas saying the bill el Trumpo signed was “all temporary and stuff.” So I looked into it. The bill Trump signed as the much ballyhooed “budget deal” was an Appropriations bill. Namely: H.J.Res.31 – Consolidated Appropriations Act, 2019. In other words, it isn’t a “Budget Resolution,” (which is something the President doesn’t sign). It’s a bill that “becomes law” when the President signs it. It’s also considered an omnibus, which means it stands in for all of the required, separate, monthly appropriations bills for the entire fiscal year, which ends in September. “Ridiculous vanity project” – the way they throw around this talking point you would think he was trying to build a Trump Hotel every few miles along the border instead of a secure barrier.

I have seen countless interviews with border patrol agents and other leos who work at the border every day and they all say they need a strong physical barrier. The see through slats seem to be currently favored so they can see what’s happening on the other side.

These Dems who actively oppose this should be ashamed of themselves.

DHS increase of “asylum processors” – by “200”
Increase in BP Agents – 2000
Increase in ICE Personnel – 750
Increase in Detention Detainment Capacity – 52,000 – Cost $4B+ over 3yr

Thank God Congress got their priorities straight with 200 more “Processors” for Asylum Claims /s

No need for new legislation. Under the Emergency Powers Act, all they have to do is pass a joint resolution of both houses of Congress and the national emergency is no more. Same as getting a new bill through both houses, except the way they’re doing it now, they need to get the President to sign it. So it’s just a political stunt.

Reading up on this I’ve come to an interesting conclusion. There will be a lot of political theater but in the end the laws are on Trump side.
