Mexican Standoff: Holder vs Issa on threat of prosecution over releasing of Fast and Furious wiretaps

In this morning’s Fast and Furious hearing, Holder, citing a direct violation of court orders, threatened that anyone at the DOJ releasing Fast and Furious wiretaps (whistle blowers) and anyone else sharing that information would be prosecuted. Issa hit back noting that Congress is not subject to that, at which point Holder said that’s not true:

They are each trying to wear the other down. Everyone in that room knows that Holder was aware of this from very early on. Holder is stalling/dragging his feet to protect Pres. Obama, who was either fully aware of the plan, or is a puppet (which I doubt). Issa knows what they are doing and is trying to rattle them, force them into a mistake with constant pressure while digging hard. We are watching a highly sophisticated game of 4 dimensional chess, and the stakes are very, very high. Texas Hold’em for a few million bucks is a child’s game for these guys.

Please sir for the sake of our republic do not let AG Holder get away with what is at the very least a gross dereliction of duty on his part. Do not let him intimidate you sir. Wait, is Issa correct? I think federal court order, if they (congress / Issa) are/is citing case law, has direct jurisdictional over congress. Something does not make sense here. I hope is behind bars; however, that does not negate court directive. can someone enlighten me?

This is the reason we have three separate branches, Holder and DOJ are of the executive, but unless Holder can get SCOTUS to block access (which I doubt they would) Issa can legally subpoena the records relative to the investigation. Holder is poking a hungry lion with a stick and if he keeps it up, he is lunch.

Judiciary Act of 1789; Section 35: ……And there shall also be appointed a meet person, learned in the law, to act as attorney-general for the United States, who shall be sworn or affirmed to a faithful execution of his office; whose duty it shall be to prosecute and conduct all suits in the Supreme Court in which the United States shall be concerned, and to give his advice and opinion upon questions of law when required by the President of the United States, or when requested by the heads of any of the departments, touching any matters that may concern their departments, and shall receive such compensation for his services as shall by law be provided.

Just a tad vague, but I don’t see anything there appointing him as the Chief Law Enforcement Officer in that description or anything that lends him power over Congress.

Strayed is right, when the DOJ was created the act gave no new legal authorities to the AG other than those already held, but did give us several new positions to delegate his workload to, as in the office of the Solicitor General, but it gave the AG an administrative position running the department.

Very interesting but I do not believe they haven’t read the Constitution or do not understand it. A massive and well funded cult of lawyers and legal “scholars” have set all these tests up. These decisions and these judges use legal precedent, not the intent of the Constitution. The strategy is to undermine the Constitution through precedent. This is all intentional.

They want to set such a massive amount of anti-Constitutional precedent that we can never unwind.

I agree with you. As with the cases about Obamas eligibility, they try to avoid going to the Supreme Court because, I believe, they know where it will go. His lawyers are indeed very clever. But, sooner or later, as in Georgia, that cleverness will backfire on them.

Now, he’s threatening members of Congress with prosecution, if they continue to look into this, aggressively. There should be no more week long deadlines; he should be ordered straight away to produce documentation within the hour, or face criminal charges of Contempt of Congress; possibly multiple counts. My theory on that is that there are very few in Washington (elephants included) who actually want this to be prosecuted. Some elephants may feign outrage and some like Issa will go after a few. But the elephants and donkeys now form a very powerful political class controlling our government instead of us. What keeps them (elephants and donkeys alike) from further cementing that power into their hands, is the Constitution, the rule of law, and the separation of powers built into the 3 branches. Obama has done more to ravage those protections than all his predecessors combined, and the political class in DC sees the value in letting all of Obama’s (il)legal precedent stand. The republicans and democrats are essentially two competing crime families. Obama and Holder have eliminated the cops, the prosecution, the newspaper reporter, the judges and most of the law. I think you are right, there is so much money being laundered through the drug cartels that anything more than cursory indignation would bring down a huge contingent of our government.
