Media says Mueller objected to Barr’s four page memo on Russia report, but Mueller admits his problem was with the media, not Barr’s memo!

If you are watching CNN or MSNBC, you’ll know then they are going crazy right now with this news that Mueller wanted Barr to release more initially on his report.

Here’s what the Wapo report says:

Special counsel Robert S. Mueller III wrote a letter in late March complaining to Attorney General William P. Barr that a four-page memo to Congress describing the principal conclusions of the investigation into President Trump “did not fully capture the context, nature, and substance” of Mueller’s work, according to a copy of the letter reviewed Tuesday by The Washington Post.

Days after Barr’s announcement, Mueller wrote a previously unknown private letter to the Justice Department, which revealed a degree of dissatisfaction with the public discussion of Mueller’s work that shocked senior Justice Department officials, according to people familiar with the discussions.

“The summary letter the Department sent to Congress and released to the public late in the afternoon of March 24 did not fully capture the context, nature, and substance of this office’s work and conclusions,” Mueller wrote. “There is now public confusion about critical aspects of the results of our investigation. This threatens to undermine a central purpose for which the Department appointed the Special Counsel: to assure full public confidence in the outcome of the investigations.”

The letter made a key request: that Barr release the 448-page report’s introductions and executive summaries, and made some initial suggested redactions for doing so, according to Justice Department officials.

In his letter, Mueller wrote that the redaction process “need not delay release of the enclosed materials. Release at this time would alleviate the misunderstandings that have arisen and would answer congressional and public questions about the nature and outcome of our investigation.”

After the letter, Mueller called Barr to discuss this further.

Note the portion that I bolded below:

A day after the letter was sent, Barr and Mueller spoke by phone for about 15 minutes, according to law enforcement officials.

In that call, Mueller said he was concerned that news coverage of the obstruction investigation was misguided and creating public misunderstandings about the office’s work, according to Justice Department officials.

When Barr pressed him whether he thought Barr’s letter was inaccurate, Mueller said he did not, but felt that the media coverage of the letter was misinterpreting the investigation, officials said.

In their call, Barr also took issue with Mueller calling his letter a “summary,” saying he had never meant his letter to summarize the voluminous report, but instead provide an account of the top conclusions, officials said.

Justice Department officials said in some ways, the phone conversation was more cordial than the letter that preceded it, but they did express some differences of opinion about how to proceed.

Barr said he did not want to put out pieces of the report, but rather issue it all at once with redactions, and didn’t want to change course now, according to officials.

Two points.



First, Barr’s four page memo was never supposed to “fully capture the context, nature, and substance” of the report. He made clear that this was just a preliminary report – not a summary – and that he would fully release the actual report soon thereafter.

Secondly, Mueller told Barr that his initial report was ACCURATE, that his concerns were with the media creating confusion over it.

From the explanations above, it sounds like Barr has been very consistent with how he wanted to release the report, and he clearly didn’t want to change his plans just because Mueller had a bee in his bonnet.

Also, Barr told Mueller the same thing he told everyone else, that his four page memo was not a summary, but rather a presentation of the top line facts. See, consistent.

But don’t tell that to Julian Castro, who is now calling for Barr to resign for misleading the American people or something:

How did he mislead anyone? Mueller said Barr’s report was accurate, and Barr has since released the entire report for all to see. It proves his memo was accurate, just as Mueller agreed.

Ugh. Castro is just an idiot Democrat trying to raise the profile of his 2020 presidential campaign. With nonsense apparently.

          The reality was that most of the media was in a panic that the collusion narrative was disintegrating and they were looking for a way to keep the impeachment drumbeat going. They were desperately pursuing the Democrat House member angle of getting the full unredacted report, getting every indictment transcript, and getting every supporting document.

          The goalpost move to obstruction being the only thing to talk about had been completed at that point.

    Since the entire report was released as quickly as possible, there’s no real substance behind this complaint. The real goal is to make Barr look questionable right before he testifies to the Senate. Because that’s all they really have left.

    That said, this story does reveal a few things:

    Contrary to the general impression left by the media, Mueller is not a just-the-facts-please-we-have-a-job-to-do prosecutor that some want to pretend. Someone like that would not be worried about how the public was responding to Barr’s letter, as long as the full report was getting released.

    Mueller in fact reveals himself to be very concerned about how his investigation is perceived by the public. That was actually made manifest when he unleashed the pointless indictments of Russians who would never see a day in court, prioritizing the PR gain above any actual effective countermeasures against Russian intelligence. But this makes it clear that Mueller was watching the news, and trying to manipulate the public perception of him. Much like a certain James Comey.

    In fact, this concern with his public image suggests that he was not approaching the investigation like a prosecutor, where the decision to indict or dismiss based on the evidence is the end of the matter. Which goes a long ways to explain why he didn’t “make a traditional prosecutorial decision” about obstruction, but left it hanging in a way that no prosecutor would ever do with someone he had decided not to charge.

    Again, making a big announcement about charges he declined to indict for was very similar to what Comey had done in making a big announcement about Hillary’s mishandling of classified information while claiming that no reasonable prosecutor would attempt to try such a case. The biggest difference between the two is that a) Hillary was easily documented to have broken the law, while no evidence was ever found that the Trump campaign even colluded with the Russians, much less engaged in a criminal conspiracy, and b) Comey’s actions were clearly meant to close the door on further action against Hillary, while Mueller was trying to do the exact opposite to Trump. Oh, and c) Comey was fired for his shenanigans, as opposed to Mueller

    While not explicitly stated anywhere — Mueller implies instead that he just doesn’t like how the media handled the story — it seems rather obvious that Mueller is unhappy about Barr’s general handling of his probe, yet unable to claim that Barr was in any way inaccurate.

    This may be subjective, but it sure does seem like Mueller thinks himself the equal or better of Rosenstein or Barr, and doesn’t seem to respect that his role is to work under the supervision of the elected president and the Attorney General he appointed. You almost catch a whiff of “Eau do Deep State” from the tone of his complaint that the person he supposedly answers to isn’t giving his report the attention it “deserves.”

    McCarthy also points out that this letter was obviously written for public consumption, not for the Attorney General, just as the report itself was done.

    The truest statement from Mueller was when he confessed to not “making a traditional prosecutorial decision” on obstruction. Mueller hasn’t acted like a prosecutor. He’s acted like a politician pushing a narrative. When the facts don’t support collusion, he spends 200 pages detailing contacts between Russians and the Trump campaign as if collusion existed, but painfully admitting in each case that no evidence was found.

    Barr releasing the bottom-line conclusions without all the BS leading up to it emphasized the lack of any real evidence of a crime, or even of coordination. Mueller found this intolerable, but can’t point to any actual inaccuracy.

    Of course, it should be the other way around. Between Mueller and Barr, it’s Barr who was appointed and confirmed as AG, and is the only one who should be looking at the politics of the question. But instead, it’s Barr who has to step up and act like the prosecutor because Mueller was too busy acting like a politician.

He’s worried that if the Trump isn’t on defense for the next two years, his administration might have time to looking to the deep state abuses that occurred.

    The whole report should have been:

    In the matter of Russian conspiracy with Trump campaign officials – no prosecutable evidence was found.

    Then maybe he could have included summaries of the dead ends his team ran into investigating Page, PapaD, Flynn, Trump Tower meeting, RNC Convention, etc.

    But that was it. The whole obstruction case was always a non-starter. He knew that. This is all political.

    Americans need to be responsible, turn off your TV and read the first 200+ pages of the report. Come to your own conclusions. Don’t allow the media to sway your opinion one way or the other. The truth will reveal itself when you do your own investigating. If you don’t do this, consider yourselves part of the problem, dumbed down by the media.

  26. I see from media coverage that this is supposed to be the big story tomorrow. Having failed to show any collusion, and failed to make any plausible case for obstruction, they will now attack the AG and try to smear him as well. We already have Dem senators calling for an IG investigation into Barr, and several senators and Congressmen demanding Barr be impeached.

    I have a feeling it may backfire, because I think Barr really wanted to back away from discussing the Mueller report any more and let Congress argue and debate it. Instead, they intend to stay on the attack, and are probably going to look pretty bad when their criticisms get answered, and they look like partisan hacks.

          The goalpost move to obstruction being the only thing to talk about had been completed at that point.

  35. I see from media coverage that this is supposed to be the big story tomorrow. Having failed to show any collusion, and failed to make any plausible case for obstruction, they will now attack the AG and try to smear him as well. We already have Dem senators calling for an IG investigation into Barr, and several senators and Congressmen demanding Barr be impeached.

    I have a feeling it may backfire, because I think Barr really wanted to back away from discussing the Mueller report any more and let Congress argue and debate it. Instead, they intend to stay on the attack, and are probably going to look pretty bad when their criticisms get answered, and they look like partisan hacks.
