A Texas judge has just ruled that the rogue Democrats returning to the state cannot be arrested and forced to return to the legislature to establish quorum:
DC EXAMINER – A judge in Austin, Texas, issued a restraining order preventing the arrest of state Democrats as they return from Washington, D.C., after breaking quorum over a Republican-backed voting security bill.
State District Judge Brad Urrutia, a Democrat, signed the order on Sunday, giving the green light for Texas Democrats to return to the state without fear of arrest, according to the Texas Tribune. Texas Gov. Greg Abbott has repeatedly warned the runaway Democrats that he would utilize law enforcement to detain them and force them back to the legislature to establish quorum.
The restraining order stems from a lawsuit filed by 19 Democrats seeking to restrict Abbott and House Speaker Dade Phelan from arraigning Democrats who refuse to attend votes on the reform bill.
“No matter what the governor or speaker have said, it is a fundamental principle in this country that no one has the power to arrest their political opponents,” Samuel E. Bassett, an attorney representing the Democrats, said.
Sunday’s ruling also follows Abbott’s decision to convene a second special session of the legislature starting Saturday in a new attempt to pass the voting reform bill.
Of course it’s a Democrat judge who is preventing the arrest of these Covid-superspreading Democrats after the stunt they pulled.
So if they still refuse to show up to establish quorum, then what does Abbott and the House Speaker do? Will these lawless Democrat simply be allowed to continue to be lawless?
A statement from Abbot’s spokesperson, which the Examiner failed to include, suggested this ruling would be appealed and that they were confident it would be overturned:
Abbott spokeswoman Renae Eze called Monday’s order an overstep and said the governor’s office is confident that it will be overturned.
“The ruling by the Travis County judge is contrary to the Texas Constitution and violates the separation of powers between the different branches of government,” she said in a statement. “Texas Democrats need to stop the charades and get back to work.”
I hope they can get this ridiculous ruling overturned fast because if they can’t, the next step, I presume, would be holding new elections to replace these Democrats for failing to do their jobs, that would definitely take much longer.
