Texas soldier who shot and killed BLM protester last year charged with MURDER

Last year we reported on the story of a soldier from Fort Hood encountering a BLM mob in Austin as he was ubering people around, and ended up shooting of the protesters after he pointed an AR type weapon at him.

Perhaps you remember this photo, which clearly shows Garrett Foster with this AR in the so-called ‘ready’ position:

As we reported last year, US Army sergeant Daniel Perry said that Foster had pointed his gun at him and that’s when he opened fire, killing Garrett.

Now, according to a new report, Perry has been charged with murder:

NY POST – A US Army soldier who shot and killed an armed protester after driving into a Black Lives Matter demonstration in Texas last summer has been charged with murder, authorities said Thursday.

Sgt. Daniel Perry was indicted by a Travis County grand jury on charges of murder, aggravated assault and deadly conduct in the July 25 death of Garrett Foster in Austin.

Perry, who was stationed at Fort Hood, was working for a ride-sharing company and just dropped off a customer when he turned onto a street filled with people protesting police brutality.

He stopped his car, honked, and seconds later, police said Perry drove his car into the crowd, The Texas Tribune reported.

When the crowd surrounded the car Perry encountered Foster, a 28-year-old Air Force veteran, who was holding an AK-47 rifle. The rifle was legal under Texas open carry laws.

There are conflicting accounts of what unfolded next, but the incident ended with Foster dead of multiple gunshot wounds. Cops said that Perry, who was also legally armed, fatally shot Foster with a handgun before fleeing the area, the Tribune reported.

Perry was arrested after the shooting and then released without charges pending an investigation.

His attorneys have said that the soldier acted in self-defense after Foster aimed his weapon at him.

They said that the protesters had begun beating on Perry’s vehicle after he turned onto the street, and that Foster approached him and motioned with his gun for Perry to lower his window.

Thinking Foster was a law-enforcement officer, Perry complied — but when Foster raised his weapon at him, the soldier realized Foster was not a cop and fired in self-defense, the attorneys claimed.

“It is important to note that the standard of proof required for an indictment is significantly less than the standard of proof required for a conviction,” Perry’s attorney Clint Broden said in a statement.

It’s one thing to open carry a rifle. It’s another thing to have it in the ready position as if you are about to shoot someone. It seems totally believable to me that Garrett aimed his AK at Perry and he fired in self defense. Garrett had no business holding it that way in the first place. Maybe he thought he was a badass with the rifle. I don’t know. But it was irresponsible and he paid with his life for that choice.

Also I don’t trust the word of these BLMers who were clearly hostile toward Perry, who’s only crime up to that point was trying to drive on a road that should have never been blocked in the first place. They surrounded his car, at which point Perry probably feared for his life, and add to that a guy with a freaking AK right outside your window.

At the end of the day, I think Perry should be free because I don’t think he did anything wrong. When someone points a gun at you, you’re life is under threat and you have the right to defend it. But of course this is Austin, the liberal capital of Texas. So I’m not shocked that they are charging him with murder. I simply hope Perry gets a fair trial and the courts realize Perry acted in self-defense.
