Two major immigration decisions were handed down today, neither a total victory or total loss for either side.
In one, an appeals court partially upheld a lower court’s ruling that the Biden administration can continue to use Title 42 for immediate deportation because of health (covid-19) concerns. But they said that a migrant cannot be deported “to places where they will be persecuted or tortured.”
In a separate ruling in Texas, a federal judge ruled that the Biden administration may NOT exempt migrant children from the policy. While deportation under Title 42 continues, in other words, children won’t coming here illegally won’t be exempt.

Under U.S. law, the government “cannot expel those aliens to places where they will be persecuted or tortured,” the U.S. Court of Appeals for the District of Columbia Circuit wrote in its 32-page ruling.
“That does not make their presence here legal,” the ruling continued. “Nor does it give them a path to asylum. Nor does it stop the executive from detaining them. to expel them to a country where they will not be persecuted or tortured.”
The White House, Department of Homeland Security and Centers for Disease Control and Prevention declined to comment.

A federal judge in Texas on Friday ruled against the Biden administration’s decision to exempt unaccompanied children from a Trump-era order that U.S. border agents have used to rapidly expel hundreds of thousands of migrants during the coronavirus pandemic.
Granting a request made by Republican officials in Texas, District Court Judge Mark Pittman barred the Biden administration from exempting migrant children traveling without their parents from the pandemic-era expulsion policy, which is known as Title 42, a section of the U.S. public health code.
Biden, like all Democrats, always wants to have his cake and eat it too. He wants the left to think he’s open borders, and he wants Middle America to think he’s putting their needs before illegal immigrants.
These rulings, the second of which will now face appeals court and the first of which may go to the Supreme Court, show the practical effect of Biden policy is to turn everything into a mess, and the American people get the worst of everything.
Night-time flights taking illegals to American cities, other night flights deporting other illegals for not wearing a mask or looking covid-y, thousands upon thousands just walking across the border every day with no consequence, and children in cages for weeks or months because Biden can’t figure out what to do with them. All while the courts have to keep ruling for and against our insane policies.
