Andrew McCarthy was on Fox News this morning to discuss Judge Sullivan’s delaying of Flynn’s dismissal and why it’s so bizarre:
McCarthy says Judge Sullivan delaying the Flynn dismissal for the purpose of accepting amicus briefs is bizarre because judges don’t normally entertain amicus briefs in a criminal case, because it’s simply the state or government against an individual.
But with Judge Sullivan, who McCarthy says has been fairly unhinged with the Flynn case, he’s decided to entertain these amicus briefs for what he calls an ‘anti-Trump therapy session’, giving groups like the anti-Trump Watergate Prosecutors a chance to voice their displeasure at the DOJ dropping the case.
Even though, as McCarthy points out, it won’t matter in the end. It will just prolong this part of the process before Sullivan accepts the dismissal from the DOJ.
