A federal judge has just blocked the Title 42 policy to expel illegals on the basis of public health.
The lawsuit was brought by the ACLU and, for now, the Biden administration won’t be able to use Title 42 as an excuse to expel illegals.
BREAKING: A federal judge has just blocked the use of Title 42 at the border as a result of ACLU litigation. Title 42 allows the U.S. to immediately expel migrants on the basis of public health. It has been used millions of times under both Trump & Biden. T42 is gone, for now.

Already hearing from multiple Border Patrol sources that they will be expecting a significant surge/rush of migrants at the border once word gets around about this order, on top of numbers that are already at all times highs even with Title 42 in place.

Here’s more from CBS Reporter Camilo Montoya-Galvez:
BREAKING — U.S. Judge Emmet Sullivan voids the Title 42 order that has allowed U.S. border officials to quickly expel migrants, finding it "arbitrary and capricious in violation of the Administrative Procedure Act" pic.twitter.com/E9tzNDtZpq

This is a major ruling with huge implications. It prevents the U.S. from expelling any migrant under Title 42, a public health authority first invoked by the Trump administration.
Judge Sullivan refused to suspend the ruling pending an appeal. More to come … @CBSNews

Judge Emmet Sullivan was appointed by Bill Clinton to his current post. In case you have forgotten, this is the same corrupt judge who refused to dismiss the DOJ’s case against Michael Flynn back in 2020 when the DOJ requested dismissal.
I would hope that the Biden administration would appeal this ruling to a higher court, but that remains to be seen.
